It is expected that the recent amendment to the Companies Law no. 31/1990 and the Accounting Law no. 82/1991 should be welcomed by the business community in order to solve two problems with which companies and their associates frequently faced (im)possibility to distribute dividends during the year.
The distribution of equity items (equity, profits, reserves, bonuses, etc.) is treated succinctly and relatively rudimentarily by our legislation, the basic principle being that distributions to affiliates can only be done under strictly statutory conditions.
